Submitting a copyright removal request

At BakanalTV Studios LLC, we take copyright infringement very seriously. If your copyright-protected work was posted on BakanalTV Studios LLC without your authorization, you may submit a copyright removal request to ask that the content be removed from the Company’s platform. We will promptly remove the copyrighted work and perform an investigation to ensure your copyrighted-work is protected. Submitting a copyright removal request is a legal process.

Important Information to Know – Prior to Submitting a Request for Removal

1. Copyright Exceptions: Prior to submitting a removal request, you must consider whether fair use, fair dealing, or another copyright exception applies. The Company may ask you to confirm that you have considered the possible exceptions and content will not be removed until you have supplied an adequate response. In cases where an exception does apply, requests are invalid and content does not need to be removed from the platform.
    

2. Personal Information

   • After a video is removed for copyright infringement, the Company will display the name of the copyright owner in place of the video.
      

     • You may provide a valid legal alternative if you wish, such as the name of a company or an authorized representative. The Company will review the information you provide and apply it where possible.
        

     • Any copyright owner name entered by you will become part of the public record of your request. To learn more about the public record of your removal request, click here.
        

   • What information is required to complete the copyright removal request?
      

     • Your full legal name. Your name may be shared with the person or entity that uploaded the video being removed.
        

     • Your primary email address. Your email address may also be shared with the person or entity that uploaded the video being removed. This person or entity may use your email address to contact you in an attempt to resolve the copyright issue.
        

     • Your physical address and phone number. This information will remain confidential except if it is requested for a lawsuit. If the Company is legally required to share this information, you will be notified prior to this information being disclosed.
        

3. To file a valid copyright claim (most commonly known as a DMCA Takedown Notice under U.S. law), the Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)) sets six strict legal requirements:
    

   • Contact Information: Your full name, physical mailing address, telephone number, and email address.
      

   • Identification of Your Original Work: A clear description of the copyrighted work you own (e.g., a link to your original work online, or an attached copy of the file).
      

   • Identification of the Infringing Material: The exact web address (URL) or specific location where the unauthorized content is posted so the service provider can find and remove it.
      

   • Good-Faith Belief Statement: A statement declaring that you have a *good-faith belief* that the use of the material is not authorized by the copyright owner, its agent, or the law (such as fair use).
      

   • Accuracy and Authority Statement: A statement made *under penalty of perjury* confirming that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
      

   • Signature: Your physical or electronic signature.
